Terms of Service

These Terms of Service ("Terms") govern your access to and use of Outagely (the "Service"). By accessing or using the Service, you agree to these Terms.
1) Eligibility and authority
You represent that you are legally able to enter into these Terms and, if using the Service for an organization, you have authority to bind that organization.
2) Acceptable use
You may use the Service only for lawful purposes. You must not:
- Use the Service to violate any law, regulation, sanctions, or third-party rights
- Use Service data to support fraud, abuse, harassment, cyberattacks, or any malicious activity
- Attempt to disrupt, overload, probe, or degrade Service infrastructure
- Circumvent security controls, authentication, rate limits, robots controls, or access restrictions
- Introduce malware, bots, or automated behavior that harms availability or reliability
- Abuse subscription limits (including excessive follow/unfollow churn or attempts to bypass service caps); such abuse may result in immediate account termination
3) Anti-scraping and automated access restrictions
Except where explicitly authorized in writing by Outagely, you may not:
- Scrape, crawl, spider, harvest, index, mirror, or systematically extract data/content from the Service
- Use automated tools (including bots, scripts, browser automation, or LLM agents) to collect substantial portions of Service content
- Repackage, resell, redistribute, republish, or create derivative databases based on Service content
- Bypass technical protections (including rate limiting, IP controls, request validation, or anti-bot measures)
Outagely may suspend or block suspected abusive traffic, without notice, to protect users and systems.
4) Accounts and security
If account access is enabled for certain features, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must promptly notify us of suspected unauthorized use.
5) Paid plans, billing, and changes
- Paid features may be offered by subscription and may auto-renew unless canceled before renewal.
- Prices, plan features, and limits may change prospectively with notice on the Service or by email where applicable.
- Unless required by law, fees are non-refundable after a billing period starts.
- You are responsible for applicable taxes, duties, or governmental charges.
6) Data, accuracy, and no warranty
The Service provides best-effort outage visibility based on third-party sources. Data may be delayed, incomplete, inaccurate, or unavailable. You are responsible for validating critical decisions against official vendor status pages and your own telemetry.
7) No professional advice
Content is for informational purposes only and does not constitute legal, financial, compliance, or operational advice.
8) Intellectual property
Outagely and its content, design, software, and branding are protected by intellectual property laws. No license is granted except the limited, revocable right to access and use the Service under these Terms.
9) Suspension and termination
We may suspend, throttle, or terminate access at any time (with or without notice) for violations, abuse, security risk, legal requirements, non-payment, or operational protection.
10) Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
11) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SSSSTATUS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SSSSTATUS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID TO SSSSTATUS IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
12) Indemnification
You agree to defend, indemnify, and hold harmless Outagely and its operators from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of law or third-party rights.
13) Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless prohibited by applicable law, exclusive venue for disputes will be the state or federal courts located in Orange County, California, and you consent to personal jurisdiction in those courts.
14) Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including internet outages, provider API failures, natural disasters, labor disputes, war, terrorism, civil unrest, or government action.
15) Changes to the Service and Terms
We may modify or discontinue any part of the Service at any time. We may update these Terms by posting a revised version on this page with a revised "Last updated" date. Continued use after changes means you accept the updated Terms.
16) Severability and waiver
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver of that provision.
